Need help with Texas laws
Date: Thu, 04/13/2006 - 09:36
If anyone read my other post about my T&C payment, you know I am in a bind. I have got to get some of these loans dismissed in order to have money to live on.
I have looked at the Texas Attorney general site and the consumer commission site. I guess I am not bright enough to find what I need. I am looking for the laws for Texas that says these PD places have used illegal practices with me and my accounts. I have seen a lot of you cite specific laws in letters that you have used to get the loans marked as paid in full. Please help me find what I am looking for.
Thanks,
Crystal

txtreasure, don't get scared. These companies you have mentioned are in violation of most of the state laws. CTC has never taken anyone to the court. They haven't filed any legal case on anyone (I haven't heard). GFSIL is another name for ICS. They have also broken many state laws and are not licensed in most states. GECC, ameriloan and Mycashnow also have several complaints against them. Search in this forum and you will find many experiences of others dealing with this company. There has not been any legal case on anyone, at least on those who have paid the principal loan amount. I believe you have sent payments to these companies. Check your statement and find out how much you have paid on these accounts. Your state has some fixed lines of charges and interests. You are bound to pay that much only fixed by your state. Get all documents to prove that you don't owe them anymore.

4 of my 5 are listed with T & C so we shall see but here lies the problem as they wont send me a detail of the accounts, or a statement of the account so I can see where they get the fees and where they are adding them to the loan,
I dont want to overpay them is all But I do know that I owe them more money too and I will pay what I owe them and not a dime more!

I will do something like this
1) Review your bank statements and find out how much you have paid by now.
2) See your state laws for the permissible interest charges and roll over fees.
3) After you find out the balance, keep that money separate so that you can send it to them after they give you something in writing. You don't want this debt to add further and it should be within the regulations of your state.

What if I cant get something in writing from them?
I did get a collections notice from one of them but no breakdown like i asked for I will send out letters again Monday to all of them and see what happens and take it from there
I doubt that they will give you a breakdown of what you've paid,
I doubt that they will give you a breakdown of what you've paid, etc. I had one call me today and it took me like 7 times of saying "how much have I already paid you" (I knew before I asked) before she would answer me. Plus when I started quoting my state laws I got a supervisor. They hate it when you know more than they do.
Do you have your old bank statements or can you get copies from your bank? The best thing you can do to help yourself is figure out how much you've paid already and what your state laws are. You need to pay back the principle not not all the excessive fees they try to charge. You seem to know what's going on - just keep fighting them. Make sure if you're sending letters U.S. mail that you're sending them CMRRR so you have proof they got them.

Sue,
So far I have sent the letters stating my state laws requesting response to that or that they make settlement arrangements with me or I would take further action against thier company, Have not heard a thing from those and most of those went out about a month ago, I will send another letter Monday to them in hopes that they will call me to settle these accounts with a fair payment plan as they told me they would only accept Western Union and I dont want to do it that way I want a physical address to send payment to so that I can send it certified mail
any other suggestions?
I dont want them taking me to court
I will also call the bank and see if I can get a printout of my old account
So then I know for sure how much I do owe them
Thanks for your advice and help Sue I appreciate it very much, This is so stressfull for me, I want to wake up and it be a bad dream,
It keeps me up at night my BF said I talked in my sleep the other night and I sat up and said to him
" Why dont you do me a favor and get these illegal Pay day Loan lenders to work with me"
He doesnt knwo anything baout this I flipped out when he told me that

Okay, that's not funny at all. You need to calm down and not worry about it so much which I realize is much easier said than done. Have you tried faxing the letters and emailing them? If they're online lenders they won't take you to court. Are you with T&C or anyone or going it on your own?
Maybe you should tell someone close to you that you can trust that will understand, it may help but I am always here to listen and there are a lot of others that will too. Take care!

These lenders won't take you to court...if they do, I'll eat my computer!
They are illegal...there's no way they'll step foot in a court of law!!!!
Calm down and keep on doing what your doing, this is what we all have been doing and we're in the same boat here.
I have 3 that refuse to even call me back after I sicked the state on them! My accounts are probably closed, but they won't send me any official letters to that effect.
I figure, if they don't want to talk to me, then I'm ok with that! Some things are just better left alone...
I needed that today Thank you sometimes it does get overwhelming
I needed that today Thank you sometimes it does get overwhelming with these creeps, And they are relentless, I did call T & C and talk to them just a minute ago and I will double check my old account and change the amount with T & C that I actully owe them to reflect what my state laws are
You need to take care of yourself and don't let them get to you.
You need to take care of yourself and don't let them get to you. You know you're state laws and that's about 90% of it. You don't have to answer if they call you remember.
