Sonicpayday has me steaming mad!!!

I just talked to Ivory Kerry with sonicpayday. First of all she told me that they don't accept partial payments only payments in full. I asked her if that meant that they would send back the payments they are receiving through T&C. She said no, they would apply those payments to my balance. I told her "I thought you just said you don't accept partial payments". She then told me that's not what she had said. She then says that they would contact my payroll department to get payment in full if it meant taking my whole check. I told her that I would be contacting my payroll department to revoke any wage assignment sonic would send them. She then told me that then they would take me to court and I would have to pay the court costs. I told her fine, go ahead. I immediately contacted my payroll dept. They told me that if they received a legal wage assignment, they would have to honor it! I thought that a wage assignment had to be signed in person to be legal. I need to know about this. What constitues a "legal" wage assignment? My payroll clerk did say that they could only take 25% of my paycheck, if anything. She then said if the wage assignment was not legal, they would have to give her the proper paperwork. My concern is, what if 4 or 5 of the payday lenders decide to send the wage assignment and my payroll acknowledges it. 25% times 4 wage assignments= 100% of my check. Or can they only take 25% TOTAL of the paycheck? I'm mad and confused.


That's why I don't accept calls when I know it's Sonic! They have been calling my references as well. One is my friend, and they only identified themselves as "Sonic" and were trying to contact me...my friend thought I was applying for a job at Sonic drive-in! LOL! I am wondering also about the wage assignment. I live in Texas...and I hear it's illegal to do that here...is this true?

ilove, immediately fax/email sonic that your are immediately revoking any assumed/agreed wage assignement under the premise that they are operating illegally in your state and therefore your contract with them is null and void. Give a copy of that letter to your payroll department and tell them that if they receive one it is not legal and therefore they are not only not compelled to honor it, they are exposing themselves to legal action if they do.

I am getting ready to fax sonic the following letter:
I am faxing this document in order to authorize your company to speak to T&C regarding my account.

I am also faxing ANOTHER copy of a letter faxed to you on March 25, 2006 and sent Certified Mail with Return Receipt (received and signed for on March 28, 2006). This letter gives all information in regards to my account and its repayment as well as fully revoking the voluntary wage assignment on this account.

I am once again immediately revoking any assumed/agreed wage assignement. A copy of the letter along with the evidence of receipt of the letter by you has been delivered to my payroll department.

Thank you for you assistance and cooperation in this matter.

Sonic uses this tactic on a lot of people here, including myself. They have no legal grounds to sue anyone because they are not a licensed company. I've checked several states and no Sonic Payday or affiliate is licensed with that state. If they are accepting payments through T &C, then they really shouldn't be pursuing the matter any further. I faxed a letter to their collections department and had my debt written off two days later. I told them I was getting ready to sue them for so many law violations that it made your head spin. Refax the letter to them and to their collections department. Tell your payroll department that this debt is consolidated in a debt management program as well. You really don't need to be more specific than that with them. I wouldn't pay Sonic another dime. They are nothing but crooks in my opinion. Now I am getting e-mails to reloan with them since I'm such a great customer LMAO! I think they need to take me off that automated list.

I'm not sure, but I think it goes like this.

Say, your paycheck amount is $200. So the first lender that asks for garnishment/assignment whatever, will receive, 25% of $200 = $50.

Now your paycheck amount is $200 - $50 = $150, right?

So the second lender will receive 25% of $150 = $37.50

Now your paycheck amount is $150 - $37.50 = $112.50 ....
