Summons, help!!

I have gotten some advice on here about how to proceed with this. I received a summons last week to my door. The processor just handed it to my friend and said to give it to me. (Strange!) I just don't know what to do next. I know that I owe this money and I am now in a situation to where I can pay them back with payments. I don't want to go to court over this and the summons states that I have 21 days to answer to it. What does that mean? What do I have to do? Someone, please help!! Thank you.

I FINALLY ( emphasizing the finally) received an email from the lawyer that I have been trying to get in contact with. He gave me his cell phone number so we can discuss my options. I was concerned about one thing, he broke down all the fees that I am going to have to pay back, but he also stated that I have to pay a 5.221% interest until the balance is paid in full, how can I ever pay it back if the interest just keeps tacking more on? Does that sound right at all?

Thank you all so much for your help. I finally got in touch (on the phone!!) with the attorney last night, and he sounds like a real schmuck! But anyhow, he wants me to propose a payment agreement to him and email it and that should be settled out of court. The weird thing though, is that he wants all payments made out to him, should I make out any money orders to the money for which I owe?

It's not too personal at all....
I took out a pdl with a local company in my area. I was unable to go back on the pay back date with the full amount because I was dropped down to part time at my office. They told me to just come in with what I could and we could make payment arrangements. In the mean time, they were sening mailings to the wrong address for me and they say, they couldn't reach me so they forwarded my account to their attorney. I talked with an employee there atleast once every two weeks to tell them the status of my payments. Then low and behold, I was served my summons.

I had HSBC in consolidation and they were being sent and accepting payments from T&C and cashing the checks. Then WHAMO, I got served a summons to appear for failure to pay. HSBC is claiming that they haven't recieved one payment from me. T&C got copies of the checks and sent them to the attorney representing HSBC as proof of payment sent and proof of them cashing the checks. They lied on their deposition to the attorney and I found out yesterday that if you do not work, HSBC puts a lein on anything you own til they are paid in full, regardless of whether you are making payments through credit counseling. My grandpa spoke to the attorney yesterday and paid the amount owed minus the payments that HSBC had recieved from T&C with the terms of the lein and court date would be withdrawn. The attorney stated that he would send me and him a letter stating that the lawsuit had been dropped and the lein has been removed. The attorney stated that it would report on the credit report as a paid judgement. I told the attorney that was not acceptable do to their was no court ordered judgement so he told me that it would be marked paid collections. I know that marking would hurt my credit, but at least I am rid of HSBC forever.

I don't know Tammy. I am not on our mortgage but I got included in the summons as "Jane Doe". I'm sure I will get a summons from HSBC/Beneficial down the road since I entered into debt settlement. I do work so they can garnish my wages I guess. We did make payment arrangments with our mortgage company so we don't have to go to court over that. That's a positive step. :P

From the way i understand, HSBC is filing lawsuits on anyone who is going through consolidation. In my case they weren't even posting the payments. Thank goodness T&C got copies of the payments and provided the proof that they were getting payments and cashing the checks. What a mess. I think this is the year for court summons.

Tammy that's interesting because we have 3 accounts in our T&C plan that are with HSBC and they are accepting payments. I think I need to check our statements and see what is going on. Did you ever get the letter from them that since you were going through debt counseling/consolidation that they were going to reduce your interest rate and stop charging late fees on your account? We have that on all 3 accounts? I think the total balance for all three is around $1000 but I think I'm going to check things out a little more, I don't need another summons...

After hearing all these stories of payments not being posted to the accounts, how can I get a statement from my credit card companies? All my accounts are with collection agencies and I am paying what I can on them. I know what the starting balance is and I am tracking the payments myself and printing out the checks once they have been drawn against my checking account as proof of payment.
