its amazing how quickly they settle when faced with the facts.. yet again more proof that they understand there legal position very well and that they know when push comes to shove they are likely to lose.

I'd like that letter to as I've have a loan with GW that I've had since January. It's a $300 loan and I've paid them $48 to renew every two weeks since then.

It seems many people are having wonderful success when confronting these slime balls with facts and the laws, which is great! Congratulations!
I hate to be a party pooper, but I would like to throw a word of caution out there to keep an eye on your credit reports and make sure these people who are being so agreeable today don't turn around tomorrow and report it as a charge off. Make sure you keep your documentation in a safe accessible place for at least the next 10 years, so you can dispute any false repostings with the CRA.
I really don't want to be the bad guy, but lets face it, we aren't exactly dealing with upstanding and honorable members of the community here.
I retire my soap box...

Oh Clay---thats really good food for thought. I definitely think thats good advice to be caution of. very good of you to point that out. And I totally agree about hanging on to all paperwork for at least 10 years!!!

Thanks for the advice, Clay. I didn't realize we would need to keep it for 10 year, but I do now and I will make sure I keep it. Thanks everyone!!

Clay,
I hadn't thought of that, but that is a very good idea. I would hate to find out years from now that a lender had reported it, or worse, sold it to a collection agency.

set4sail, theres some collection agencies out there that will sure try to collect it! Then its up to burden of proof. I have read so many stories here about this very thing happening. And even when you think the SOL have ran out, you can still get carted off to court. I have been slowly paying off small debts and although I wish I could throw the files in the trash to be rid of them. I have learned here, that for your own protection, you most definitely should hang on to everything, in case later you end up having to prove yourself. shirley

I say ten years to be cautious. The FCRA limtis the time it can be reported to 7 years, but I always figure better to error on the side of caution.

I agree 10 yrs is a safe idea. I remember co-workers at a mtg company talking about pulling records 10 yrs back for a mtg loan, vs 7 yrs for a consumer loan. Pays to be cautious.

Congratulations Sue! Gotta love Polly, don't you? I had one that I was hoping to call it even with, and thanks to her now it looks like I'm going to get a refund!

Can you also pm me the letter you sent to the pdl companies. I have been paying rollover fees for several months and these companies are not licensed in my state. I would like to submit something to these companies asking for them to zero out the account balance.
Thank You
