Hi I'm here as a guest here.I hope this is in the right spot.
I was wondering what I should do about a problem with an Capital One's collection Attorney not telling capital one I had PAID one account off? I called Capital one today to check up on my stats and they say "it was settled" this one wasn't I PAID IN FULL on 10/15/05 and settled the second account on 3/21/06.( at that time he refused to write a settlement letter until the other acc. was paid or settled) I already called the attorney on 4/11/06 and asked him to write to capital one and say this account is Paid in full.Of course he said "yea sure I will"..NOTHING 2.3 weeks later!
What should I do? Isn't it still looking bad on my credit report for settled then paid in full? At least I paid something but I'm mad that he isn't telling the right amount. I paid this guy for 3 YEARS and he also won't give me a letter setteling the amount just that my release from judgement is my settling? Does this sound right? Please help if anyone understands,BTW I did get the release form but it doesn't help me as it has NO amount on it.
THANKS KRIS

I think that after filing complaints as jj suggested, you will likely get a better response from the collection agency.

Also, you might file a complaint with the FTC, they oversee collections activity, as well as any division/ dept in your state that regulates collection activity.

Good luck!

Hi Kris,

I can understand the problem that you are facing! You have paid the full amount but the collection attorney has not given the right update to your credit company. As a result, Capital One has sent some information to the credit bureau that is hurting your ratings. In this situation, you need to explain the problem to the credit bureau. Highlight the item that is in error and send a dispute letter requesting for verification. Once your dispute is received by the bureau, they will conduct an investigation with the information providers and put the right posting in your file.

Keep sending letters to the collection attorney also so that you have proof of your efforts made to resolve the matter. You must do all your correspondence in writing through certified mail with return receipt requested. If required, you can hire an attorney also with all your proof in hand. The correct status of the account has to appear in your file and there is nothing that can stop it.
