On Thursday, June 23, 2005, I received a very large manila envelope from the Federal Trade Commission, Washington DC. In it were more than 100 complaints filed against Allstate Financial Services (1050 East Flamingo Road, #E-320, Las Vegas, Nevada) DBA Allstate Adjustment Bureau.

This information was sent to me under the Freedom Of Information Act.

Some of the violations are:
--Provide inaccurate information,
--Deception,
--Misrepresentation
--Falsely represents character, Amount, Status of debt
--Reinsert deleted item in file without notice
--Knowingly supplies inaccurate information to credit bureau,
--Refuses to verify debt after debtor makes written request,
--Threats of violence,
--Harassment
--Obscene/Profane language,
--Fails to reinvestigate disputed information,
--Tells someone other than debtor about the debt,
--Threatens to file criminal charges
--Falsely threatens arrest, seizure of property
--Calls debtor after getting "cease communication" notice

recieved calls repeatedly telling me case numbers that have been filed in "lexington district court"
when i call and ask if can get documentation for case they tell me it has gone on to long and must settle it here and now on the phone

yeah right i always do business over the phone love to give out personal information ........ :roll:

We haven't made any payments towards your bill. You must have mistook us with another entity, ALLSTATE FINANCIAL SERVICES. Paulmergel is very much right (Thanks Paul for your prompt response).

Sorry I did not get to finish my message above
ALLSTATE FINANCIAL calls my everyday to harass me they went into my bank account numerous time and has taken out funds with out authorzition I HAD TO FILE A REPORT WITH MY BANK AGAINST THEM...now they are calling me saying the are from the fraud division and there are going to contact the police if I dont pay.I tried to settle with them in the begining but they would not settle I cant afford to pay all this money back in one shot.What do I do?

The same thing is happening to me! I made one payment with Allstate back in Feb. and since then they have continued to take funds out of my account without myu authorzition. Leaving my bank account overdrawn. My bank will not let me file a claim against them. Spoke to a bunch of people at Allstate finally spoke to someone who claims to handle the legal department. He said they would settle my account for $224.00 then reduced it to $160.00. Don't even know what they are charging me for anymore. Just want to settle the account. Should put something in writing and I want them to remove from my credit reports. Any other advice?

Was paying $50 a month since August '07, then suddenly had $371.41 removed from my bank account UNAUTHORIZED-- one agent said it was a new merchant Vendor that did this-- and it happened to many people, they had a dispute out w/them blah blah blah-- have now talked to two 'managers' at Allstate and I'm still waiting to find out if I'll be reimbursed for the NSF fees I was billed because of their fraudulent practices...

To all those going through the same nigntmare please fight for your rights All state finanical who now call themsleves a fraud division has taken this to another level they have went as far as to contacting tha managements office where I live and explaing to them that i am under a FRAUD INVESTIGATION I cant believe they went this far..... mean while this has nothing to do about fraud and they keep taking unauthorized funds from my account.....But i have something from them because this sounds illegal.

CALL 800 697 1220 this is the new york state consumer protection board.

I just make it a point not to give ANY info about my bank acct. I do however have a weird way of dealing with them. I call them at least 7-8 times a day and eventualy they got tired of hearing my nagging voice and stopped calling.

these low life scum bags have represented themselves as a legal attorney's and stating that they have filed a legal case against me int he court of law but in fact they have not are not attorneys just bill collectors who do no follow the fair credit act, they have repeatedly taken unauthorized funds from my checking act causing it to go into overdraft even after I placed a six month stop payment at my b ank. They have even gone as far as to contact my neighbors to see if they would give them my phone number. Contacted Howard Clark show and he informed me this is strictly prohibited and this company should be stopped. What they are doing is illegal

My firm is preparing multiple class action suits against this company. if you have an account with this company, please email allstate-complaints#hotmail.com with your name and account number (if you know it) and the reason why you are making the complaint. and we will get back to you. this is completely fee free, so no worries there..

They have repeatedly withdrawn money out of our account. it has now come down to filing with the district attorney, and closing our account. They cannot collect a debt without proving you PROOF that the debt was yours. my husband stupidly gave all our information because he thought it was our debt...guess what....NOT! These people are unbeleivable...Be careful kids...9 times out of 10 a debt collector does not have the proper documentation to properly collect on a debt. they have to have the proof that you owe. they have to provide it to you when you ask.

The reason I am emailing you is becasue in 2006 I optain a Visa card and several months of use I lost my job. So I called the Visa company and explained to them when I receive another job by the time I received another job the Visa company turned my case over to Allstate Financial Services and Mr. Green consently called me. So I returned his call and he was very rude to me on the phone the Visa card remain you the card was only $500.00.

So anyway he told me that I owed over $1200.00 so not trying to mess up my credit worse than it was I agreed to have them take out of my account $50.00 a month plus I paid them a down payment of $267.00. This transaction went on for 2 years of them taking out of my account. On Sept of 2009 after I had calculated I was twenty-eight dollars left to pay on my debt and when I called them I told the women on the other end of the phone that they can stop debting my account I will sent them the $28.00 in a check. She stated to me that I still had to pay $354.50 worth of interest but she side we can close this out for $254.00.

I scrapted and I borrowed to come up with this money to pay them off and never hear from them again. I gave them the money on September 25, 2009 and I have the paid in full letter from them. And on October 30, 2009 they went into my account and stole $153.50 cause this in my account to go into the red things in my account bounced and I had to pay overdraft fees because of them.

I called them several times demanding my money be returned I have been lyed to because as of November 14, 2009 I have not received a dime. I called them on Novemer 13, 2009 only to be hung up on twice trying to speak to an Alexandra Morgan or a Karen Redmond. I was told to hang on and then for about five minutes the phone was hung up and when I called back "she just went into a meeting." Then I ask to speak to someone concerning the return of my funds and guess who they gave me to that Mr. Rude Green. acting like I owed him money instead of the other way around.

He said "I see that we owe you a refund but I don't know where it is I have to research it and its going to take a couple of days. I went to my bank and closed my account and also went to the police and filed a "theft my institution" against them. So is their anything else that I can do. I want them to stop cheating people and if I can be of any help please email me to let me know. *****************

To make certain I understand you... You got a Visa card in 2006. You used it for several months, and then quit paying on it due to job loss. Sometime later, Visa assigned/sold the account to Allstate. At the point you stopped paying, the balance on the card was about $500.00. Correct?

And you entered into a payment plan to give them the (probably enormously inflated) amount they were demanding. Likely because they scared you into it, yes?

You paid that plan off in full on 10/25, and then they got back into your account, taking more money after you had proof of payment in full. Causing you substantial overdraft fees and other problems.

OK, gotcha. Have you files a fraud report with your bank? It may well be too late at this point, seeing as how you've closed the account, but I'd do it anyway. Go to your bank in person. Take your documentation with you. Speak to the branch manager, not a teller. Tell him that you were the victim of a fraudulent withdrawal, and that you want your $153.50 back, plus reimbursement of all fees related to this incident. Do not take no for an answer. And do not leave the bank without something in writing, showing that you've filed that report.

Then, go to the National Association of Consumer Advocates website, and search out an attorney close to you. One of them should jump all over a slam-dunk case like this. And it won't cost you, because they can recover their fees from Allstate.

Allstate left a message on my machine claiming their "client" was in a position to settle. I returned the call and spoke with a Madison Leftbridge, if that is really her name, who constantly interrupted me, threatened to sue me and take me to court. I told her I know my rights, that I was getting my own lawyer and would get the judgment vacated. She retorted "Well, if you can afford a lawyer you can afford to pay the bill". Yeah, right, I responded by saying "...getting a lawyer and paying for one are not the same thing". I am currently unemployed so good luck collecting.

Allstate took 660.00 out of my account unauthorized on December 23rd 2009. I have two kids and it ruined our christmas. We can not pay our rent now and I am worried about what I am going to do. I called them several times and they put me on hold and do not return to the line. first they assured me it was a mistake and that they would put the money back in my account and then later told me they consider my account closed. I was never late with payments and I feel they have stolen the money from me. Somthing should be done with this company.

It seems I have fallen a victim to Allstate Finanacial services. they are hitting my checkinga ccount for random amounts of money on random days of the month. My bank is closing the account but will not give back the NSF feese. I need a contact number for Allstate finacial. the number I have does not work???????

I see an issue, on Dec 4th they took 660.00 form me too. It ruined my holiday and they are stillhitting my account for random amount sof money. My bank is closing the account and I can not get Allstate on the phone. do oyu have a good numbe rto contact them?

I reside in Las Vegas, Nevada. They have contacted me via telephone and letter though with no creditor information. I sent hem a certified letter requesting a debt validation of course I will not receive this request. Suggestions.

if you can afford it - get a bankruptcy lawyer - a lot of bankruptcy attorney's will let you make payment arrangements for the fees associated with bankruptcy - this way you can more easily get rid of AllState - there's chapter seven, thirteen, and 11 and with chapter 7 the amount that you can keep is much more than it used to be - though amounts may vary by state

As a former bill collector; I have to agree that the collection methods being ???represented??? by/for Allstate ARE horrible. But hopefully people will continue to post and read these notes. My experience with Allstate has mainly been avoiding the calls; that is until I got a ???very urgent and time sensitive message ???from Douglas Diamond in the ???legal division??? of the corporate offices of Allstate. Because of my knowledge, I typically tend to avoid all collection calls UNTIL it gets to that almost point of legal; why, because bill collectors can???t really do anything except annoy you until they get an actual judgment filed against you in a court of law. So as my story goes; I called Douglas back and he offered arrangements to take care of this $500+ gym membership bill. I didn???t deny the debt and offered to pay it, so he offered me a lump settlement of $290 for a 1x payment which I could not do but could easily do in 2 payments. He had to go get that ???authorized??? with ???the Attorney??? and offered to call me back in 10-15 minutes. I do have to commend him for his promptness because exactly 17 minutes later, he called me back with the good news that the Attorney ???authorized 2 payments; however now, the bill would be a little over $300 and then he proceeded to ask for my checking info. Okay,1st of all, I don???t know of a SINGLE ATTORNEY who???s THAT available to answer a lowly bill collector in a 17 minute time frame and 2nd, who in today???s world still carries checks?!!? When I told him I didn???t have it, he told me to call my bank which I refused to do so he proceeded to tell me that if I didn???t take advantage of this offer, they would start legal proceedings, do an asset search, employment search, and ultimately garnish my wages. I told him I???d see what I could do and would call him back. Time didn???t??? allow me to call him back however he was very persistent in calling me 2x???s more that day with ???very urgent and time sensitive??? messages. Here???s the truth: Allstate is located in Las Vegas, NV. Douglas Diamond is calling from San Diego, CA; hence the 619 area code on the caller ID. I???m not really sure how he would be able to actually file the correct legal documents with the County Court in Las Vegas all the way from CA. I don???t??? know of any collections agency that has an Attorney working on site with them and I highly think that Douglas does not work directly for Allstate, but in fact for a separate collection agency that bought the debt from Allstate. I???m also a little disappointed that in the two phone conversations I did have with Douglas, at no point did he recite me the ???Mini-Miranda Warning??? which, ???except for pleadings associated with a legal action, all subsequent communication from the debt collector must include this warning.??? Further more I believe that Douglas Diamond is a FAKE name; yes I used one too when I collecting. With all the faux pas I???ve literally witnessed, I felt that is was my ethical duty to pass this info on to anyone else that would devote the time and energy into researching Allstate. To all that read this, please know that debtors have rights and they ARE public knowledge listed in the Fair Debt Collections Practices Act. Furthermore, you can report any problems you have with a debt collector to your state Attorney General???s office (www.naag.org) and the Federal Trade Commission (www.ftc.gov).

One quick solution: File a complaint with the Federal Trade Commission.
Reference: Name of company, address, phone number and your claim number.
Let the Govt handle these crooks..........

I had to laugh when i read this post. About an hour ago i had a very similar conversation with "Doug Diamond". I guess i asked him too many questions. At no point did i rase my voice or curse, but he said that i was "becoming beligerant" and that he was terminating the call. I believe he got angry when i asked for some sort of debt verification. He said "we, as well as Gold's, do not have to provide you with that. It's in your contract, maybe you should read it agian". To which i replied "It doesnt say that in the contract, maybe you need to read it again". He also threw in the parting shot "you can just pay the full amount now after it goes to court". I asked him three times for an employee I.D. number and he would not give me one. He claimed to be "at his office" but i could hear his children in the background. I also asked numerous times if there was somone else at their "firm" that could speak with. He flat out ignored me. Not a fan of Douggie Diamond.
