Anyone Dealt with Enhanced Recovery Corporation

I sent this several days ago with out much feed back. I really need help with this company. Back in 2002 I had a speigel account with a balance of $320.00. The company Newport News/Speigel infomed me that they no longer had a charge card carrier so I mailed a check for the balance on my account. Shortly thereafter the company went into bankruptcy. I never heard back from them regaring this account. Now present day, I've been receiving calls from this company, especially on Sunday but when I call back the number that comes up on my caller I.D. I cannot get through. Finally I spoke with someone on Monday, the 19th from ERC who advised me that I owed Spiegel/Newport News $1,162.00. They informed me that Speigel wanted their money. I explained to the collector that I did not owe Spiegel as I had paid off my account in 2003. They want proof of this payment. I changed banks several years ago and I did not have any information concerning the check and whether it had cleared. So I placed a call to my former bank's customer service line and someone advised that they could not help. I made a second call to them and was able to get some assistance. Evidenlty, the check was never cashed. ERC advised that Spiegal had charged off this debt in 2003/2004. What do I do. I live in Arizona and I know that the collection statute here is three years. I have no problem paying my original balance owed at the time I sent in my final payment. The amount they are trying to collect is over three times the original debt. Any assistance woudl be appreciated. They only gave me a twenty four hour window of time to get this paid off. They offered me a $500.00 settlement.


I know for sure that collection agency does not have access to the kind of infomation you're seeking regarding your original balance. They simply know you never paid the original bill and that you owe the amount mentioned. They purchased that debt and now you legally owe the owner of that debt...the collection agency.

They'll take a settlement and $500 sounds like a pretty good one, its basically waiving all the fees you've accrued since 2003. You could try offering $400 and tell the collector you'll pay right now. The collector might jump at that and take the money. If one collector doesn't give you what you want then try calling back and getting another one. Each collector is different.

Take your time, the 24 hour offer deadline is rubbish, they'll take the settlement any time just remember the sooner you pay it off the sooner it'll show on your credit as paid. Remember, a settlement shows as such on your credit.

I would certainly require a letter from ERC showing proof of payment.

If you want to make the collector and company angry keep calling wasting there time and attempt to get a different collector on the phone. That is a sure way to have your offer cancelled and you would not receive another offer. Collections is a business and they will work with you if you are serious, not if you attempt to play games, waste their time and keep calling different collectors. Bad idea says this collector. If people paid what they owned they would not have such problems. Once thing is for sure, you could always borrow and borrow in this country if you are not a resident, then keep crossing back over the border and leave all Americans to pay the tab with increased costs of items. This seems to be the new way to borrow and not pay back
