I need some assistance with dealing with Sonic PayDay

Because I wasn't able to pay the loan amount in full and only made a partial, I am told that I am in Breach of Contract, and that my account is going to be turned over to Universal Fidelity, and that I am going to be sued. They will not work out a payment agreement.

Sonic is a tough one to deal with. But some of the members here have still been able to make arrangements with them. If I can request Mom of twins to add her comments on Sonic here, it will be very helpful to you.
They have the legal rights to take actions if the loan is defaulted. But if you can make arrangements, they will not be willing to proceed further. Moreover, giving this a legal effect will not help them either as you still won't be able to make payments as per their request.
Your best bet will be to arrange a plan with them outside the court. Show them your will and concern to pay the debt. They might work with you. Take my best wishes along with you.

Thank you for your response. I person who I spoke with Mr. Wayne Bruce, he would not bend. Even though, he acknowledge receiving the partial payment that I had sent to them. They are giving me until 12.15.05 to pay the full amount due. If the amount is not paid to them in full, Mr. Bruce stated that my account will be turned over to Universal Fidelity, and that I will incurr additional costs, such as court fees, etc.

Keep negotiating with them because this is all what you can give from your side right now. Later when you financial situation improves, you will be more than willing to pay more. Turning the matter to some other agency will not help them in getting their money faster.
I think you will get results if you can send some more money to them. They might be insisting for a larger payment if at all, this being the reason.

This is the way I dealt with Sonic, I filed a complaint with the Attorney General in our state and the Attorney General in Pennsylvania, and Delaware. Supplied them with all documentation of every conversation and nasty letter and email from Sonic. When the heat comes down, they will accept payments. You have to watch them and tape record and document everything. I can't stress enough document, document, document! After filing my complaint they agreed to $50.00 a month. I am finding out that the Attorney Generals offices are getting very agitated with the payday loan companies. I have been battling with Sonic since August 2005. Then I receive an email that do to the nature of our complaint they will accept monthly payments. The payday loan cycle seems endless, but just remember after you get them all paid off, never get another one, they are a quick way to financial ruins. Everyone should band together and get these place shutdown.

Thank you for the information. I have filed a complaint with the Attorney General of Pennsylvania, but not in my state, and I also filed a complaint with the BBB of Pennsylvania. I guess I just don't know what to do next, I can send them a larger amount of money on 12.15.05; but not the full amount. I don't know when the Attorney General will be contacting Sonic and Mr. Bruce stated that if they do not get the full amount on 12.15.05 they will turn my account over to Universal Fidelity, and I will then incur more expenses because of legal fees, court costs, etc. Should I contact Mr. Bruce and inform him that I have filed the complaints to see if that will make him back off a little and accept the payments? Also, how would I go about seeing if they are licensed in my state?

I too have had trouble negotiating a payment arrangement with PRL. Each time I speak with them, they always refer to themselves as "Sonic....er PRL"
I have spoken with a representative who told me that she couldn't accept my partial payment and my file was going to be moved on to the next department. Then, on Friday, I got copied on an email that they sent to one of my HR reps at work. The letter was asking to verify my ssn and next paydate - however it also said that I have a loan that is seriously outstanding and have been unwilling to cooperate to bring the matter to a settlement.
Is this legal? Can PRL divulge this information to a peer at work? Our company doesn't do wage assignments (In Texas) unless it is for Child Support, Student Loans or IRS debt - plus I revoked the wage assingment and gave HR a copy to cover my bases. Also, I found it very strange that one of the "new department's" reps I spoke with suggested re-loaning as an option to pay off with them.
If I am "seriously deliquent" & "uncooperative" why would they give me their money to pay their debt??? She also said that if I reloaned, I wouldn't have to pay it back on the next payday, I could just call - that's malarkey - I am NOT reloaning with these folks - I think I need to just stick to my negotiation and hope that they will accept my installment payments.

I forgot to mention - when I asked her what would happen next, if i couldn't pay in full on 12.16 - she said that it would be moved to a 3rd party collector and that they would have the baliff or court clerk come out to my work and serve me papers that they are sueing me. She said the will only come to your work because they also work 9 to 5 hours. I confirmed, so this 3rd party collector's first step will be to serve me with summons, they wouldn't accept installment payments to pay in full within 2 months either? She said, that's right. I said, well, at least I can provide some proof and my side of the story. She was actually quite pleasant - but based on checking the serving process in Texas - I know that baliffs don't serve you - it's the sheriff or constable and they will come to your home or send certified mail.

It's unlawful for any collector to discuss your private financial information with anyone without your consent or Power of Attorney. Do a seach for "Fair Debt Collection Practices Act" and learn your right. Arm yourself with the legal information you need to know and file your complaint with the Attorney General. You have the proof they broke the law with a copy of the e-mail and a statement from your company.
Section regarding FDCPA
I have just researched this matter, of discussing wiht a third party my debt without my consent - also they seem to be wanting to verify information they already have. here is the text from the Fair Debt Collection Practices Act. In my case, looks like 2 and 5 of Section 805 were violated. I am in contact with the Office of Consumer Credit to see if PRL/Sonic Payday is licensed to lend in Texas and upon a confirmation from my HR rep that she did receive this email and it was to verify pre-filled info along with the deliquent language I am goign to forward this matter to my Attorney General here in Texas as well. Thanks to this forum, I am learning how I can succesfully repay my debts and not get bullied or frightened in the process!

Get in touch with the consumer protection office in your area. They will give you the information about license of this company in your area.
