(815 ILCS 305/15) (from Ch. 134, par. 115) Sec. 15. Method of operation. (a) No person shall operate an autodialer in this State to place a telephone call during the hours between 9 p.m. and 9 a.m. (b) All autodialers operated within the State of Illinois shall disconnect within 30 seconds after termination of the call by the subscriber or the autodialer. Where disconnection in 30 seconds is technically not feasible, the autodialer shall utilize a live operator who shall: (1) state his name, the name, address and telephone number of the business or organization being represented and the purpose of the call; and (2) inquire at the beginning of the call whether the person called consents to hear the prerecorded message. (c) An autodialer shall not be used to dial numbers determined by successively increasing or decreasing integers. (d) An autodialer may not be operated in a manner that impedes the function of any caller ID when the telephone solicitor's service or equipment is capable of allowing the display of the solicitor's telephone number. Based on subsection (a) it would appear collection agencies which rely on auto dialer cannot begin calling in Illinois before 9:00 AM rather than 8:00 as allowed under federal law.

Do you know if this "calling of hours" is just for the auto-dialer, or can a bill collector who doesn't use that device still pick up the phone at 8:00am and start dialing themselves.

In Illinois, you would file a complaint with the Attorney Generals Office. The law also continues on to specify that a live person must be available within a prescribed amount of time, I believe it is thirty seconds.

This law would apply to the use of auto dialers. I was a little presumptive by saying the state law would make the earliest contact at 9:00AM. IF they actually manually dial the number, then a CA could still call between 8:00 and 9:00 a.m.
I was using the assumption that the vast majority of agencies utilize auto dialers. This law also makes it illegal for my railroad to call me for work via their preferred method, which I must admit i am looking forward to informing them of when my vacation is over. I really hate getting called by the robo caller in the middle of the night.
