bank fraud, how to get your money back?

hello, i'm new to this forum. i was a victim of theft and my bank card was stolen and used. the bank did not cancel the card when i reported it stolen, and we have lost all of our money and are now is serious financial trouble. our credit is ruined, and we have been trying to fight with the bank to get our money back and they have refused. (we contacted the BBB, the CT department of banking, the FTC, and will be looking into a lawyer soon).

what in the world can we do? and how can we climb out of the hole of debt we fell into because of this?

Welcome to the forums. Basically what you have done, is all you can do. Have you also filed a police report. If you card was stolen, a report should have also been made, so the autorities can help track down the individual who is using you card.

You should also consider contacting an attorney as you mentioned. Your financial institution should not have hesitated even once to return your money, pending an investigation. The money is federally insured and protected.

Mikey is right,your money is federally protected,banks have insurance just for this kind of situation.They have cameras on thier atms and inside so that they can see that you are not the one who took the money out.I left my atm card at a store once,and called the minute that I noticed it,my bank froze my card on the spot,and told me that I would not be able to use it until I received my new card.I would try contacting the highest person at that bank that you can find,and get some answers as to why they did not take the proper steps to protect your money.

I am sad to know about the bank's negligence for which you have to lose your hard earned money. In any case, the banks should ensure your safety when the card is lost or stolen. They are legally answerable to you and hopefully provide some restitution.

Take a legal path and consulting an attorney will be helpful to you. Having faced the negligence of your bank, this is the only way through which you can get some justice.

Please let us know your decision and the community might be offering you some suggestions on it.

Hi,

I am sorry to hear of this unfortunate event that occurred to you. But you do have some options in this situation. First of all, if this was a true fraud perpetrated against you, then you should not have to repay the bank the entire sum that they were defrauded.

Your first option would be to contact your bank and ask them for a "dispute charges form." Just like with your credit card, when you find fraudulent charges on your bank statement, dispute the charges immediately.

However, you must file this dispute within 60 days of the time that these charges appear on your statement. If you do not act soon, then you may lose this right to dispute charges.


Also, in order to prove that you are a victim, you should file a police report. This would provide them with evidence that you are serious and this crime did occur.

Also, contact the companies where these charges were made. And obtain copies of the signature slip that consumers are made to sign when they buy something on credit/debt.

By law, these companies are obliged to give you these slips. Obtaining these credit slips is important because you can use it to prove to them that the signatures are not yours and you did not authorize those transactions.
