We had this happen with my mom-in-law, when she was still living and had moved in with us after her husband's death. She'd never balanced a checkbook or driven in her life, so this was all new to her. She took over the checking account she and her husband had with the same bank for over 20 years. She made a $0.30 mistake (that's 30 cents, folks!), and bounced a check for $3.78. The bank hit her with a $75 fee. When I called, I ended up talking to someone in a call center hundreds of miles away, who didn't know us from Adam - they reviewed the records, they said, and still refused to waive the fee. So my then-husband and I paid it for her, since she was on a very limited income. The next time I went to the bank and was face-to-face with the teller we always dealt with, I complained about it. She told me if I had come in and talked with her, she would have gone to the manager and gotten it waived, but since I had already talked to someone on the phone, and they had refused to waive it, she couldn't do anything about it.
It's all about having a personal relationship with your local bank!

Usually what happens is you will get a letter from the merchant giving you a certain time from to clear it up. If you don't respond within the time frame, they will then send it on to the county attorney. The county attorney will then send you a letter giving you a certain amount of time to clear the matter up. There are added fees once it goes to the county attorney. They usually don't immediately file a criminal report because of this. It would really consume alot of their time if they did and believe me, they have bigger fish to deal with.
So my guess is you probably got the letter fromt he merchant. I would call them and explain what happened. Most of the time, they are nice about it and will give you some extra time to take care of it.

Have you ever overdrawn with the bank you are currently using? If not, ask them to waive some of your fees and keep asking. One person might say they will do it, while another might say they won't, so keep asking until you find someone who will take the fees off. It would be best if you could go into your local branch and do this so you can make sure they take it off, if they say they are going to do so.
