Sued by bank due to PDL overdrafts

A little over two years ago, I was in the PDL mess with 6 PDLs. My bank account went into the negative due to one forgetten charge of $9.98 (totally my fault). The balance quickly grew to negative $86 due to overdraft fees, because another $1.50 ATM fee went through which they also charged me overdraft fees for (totally unfair). While my account was only negative $86, I tried a million times to talk to anyone possible at the bank to help me with this small negative balance - reverse the fees, freeze my account, close my account, make it deposit only, EVERYTHING! And the bank would not help me with anything. So I knew the inevitable storm was approaching, so I changed by direct deposit to another account because I couldn't afford the negative balance and plus all my PDLs due to come out, so the PDLs all started their debits. There was nothing else for me to do because the bank said my account would automatically close after 20 days with a negative balance. So long story short, when all was said and done, my balance was negative $1006. All of this was overdraft fees except for the $9.98 charge and the $1.50 ATM fee. The bank did not pay anything else for me and returned all the debits and checks as NSF. So now here we are two years later and I have not heard anything from anybody about this. I honestly thought maybe the bank wrote it off since it was nothing but fees, but no, I wasn't so lucky. About a week ago, I received a summons and complaint in the mail. I'm actually a legal assistant, so I understand the legal process of filing an answer to the complaint, etc., but my question is has anyone else been sued by a bank in a similar situation (due to overdrafts), and if so, how did it turn out? I plan on trying to fight the amount of fees since it is just ridiculous, however, on the other hand, the judge could find me liable for it, since it was technically all my fault in the first place. I am also willing to pay for the $9.98 plus the overdraft fee for that, since that was a purchase I made and the bank paid for me. I guess I'm just hoping that the judge will take into consideration that I realized my mistake and tried my hardest to get the bank to work with me so that I wouldn't keep accruing more and more fees, and that it seemed the bank didn't care and just wanted to get as many fees as possible. Any feedback is appreciated!


i wish i could help.. PNC gave me similar problems with payday loans - i had hundreds in fees, which i eventually paid off little by little. the strange thing is that they didnt report me to chex systems (i checked my report several times.)
i really wish i could help but i can't. they really could have blocked your ACH transactions though (as PNC could have for me..) and put a hard block on your account. I'd try to fight it..

1. They wouldn't let me file a dispute for an unauthorized charge.
2. Changed their mind, then they would let me.
3. Everything put me in negative and they told me to stay in negative and that I will be reimbursed for everything if my claim clears correctly.
4. Tested and found out that when my other party deleted a pending transaction, that Dollar Bank still pushed it through and then credited me back the next day. Which means they charged me 35 and 8 for overdraft and then 35 for a credit back into a negative balance. Yes people they charge for making a deposit into a negative balance.
That's just a small thing of everything they do...
