bank garnishment and levy

can i still spent my money even if it has a garnishment on my checking account. its from my tax refunds and some of the money from child tax credit


Did you get any paperwork from the court or your bank?

I'm not sure about other states, but in IL the court would tell you not to touch those assets until it releases the levy. If you were to take money out of your account after the court told you not to, it could be considered contempt of court.

Has the bank already put the levy on your account? If so, the money's already gone. The bank doesn't care who the money is from. All they do is honor any legal paperwork they get from the courts ordering a levy against your accounts. Any account with your social on it, even if you're a joint signer on a savings account with your kids, would be subject to the levy.
