NSF checks, redeposits and fees

I have a checking account less than 60 days old with no overdraft protection until it is at least 90 days old.

I forgot about a couple of checks I wrote to the grocery store(Winn Dixie) and did not have enough in the account to cover them. This store uses some kind of 3rd party system for their checks so I did not know who to call. I figured they would mail them back to me or call me. A week later, they redeposit them and and I get two more NSF charges. My account was still low due to being in between paydays. So I get on their website and send a "contact us" message, explaining what was going on. They sent me a phone number.

I called and they explained they will deposit a check up to three times. I got paid and sure enough the third time they both cleared.

Now the part I don't get. They told me they were also going to electronically charge my checking account for the returned check fees.

I am in Florida and was wondering how I can find out if what they are doing is legal.


Does the store have any thing posted in plain site for customers to read regarding their return policy on checks? If not, I would call the store and speak to a manager. Also call you bank and ask them if they can electronically access your account. Without you authorized a ACH I don't now how but perhaps they can?

It's surely about the terms you agreed upon while signing up. If you had agreed upon an automated clearing option, then I guess they can charge your account. If you have any paper work regarding your account, then you must go through it once.
