wamu overdraft abuse please help asap

hi. can you tell me if wamu has a policy of holding direct deposits so they can earn overdraft fees. I'm currently disputing over 2k in such fees and need to get legal remedy with proof they're doing this on purpose. they even show the funds are there then act like they're not and charge fees and then act like they posted later after I see online that the funds have already posted.


OK...I used to work there, and one thing that really confused people was that the OD fees come out the day after the account is overdrafted. So, it may be that you had items hit the account on, say, Thursday, and the direct deposit came in on Friday. You would still see OD fees from the OD's that happened on Thursday, but they would come out on Friday. Did you call or go and see the branch manager where you opened the account? They are the ones that would reverse fees if they can, since it comes out of that branches budget for fee reversals. That's the only thing I can think of, unless the direct deposit was dated to come into your account on a certain day, but the bank received it early. Then, they may put it in suspense on your account, where it's there but not available to use until the date it's really supposed to go in. That sounded confusing, but i hope it helps. Good luck. I think this is happening to me as well. My direct deposit is supposed to be available on every other Friday. However while wamu shows it in the available balance, if I make a debit that is over the amount I had before the direct deposit I get hit with an OD fee. I am going to take a careful read of their contract.

I don't know about any of this, but I hate WaMu! Mortgage is with them and I will say that they never keep things straight. I am having to do my modification all over with them because they LOST the paperwork!!! They sure cannot seem to keep things from getting lost and they keep lousy notes.

Now as far as posting items before deposit is posted, I have had that done to me many times with a bank that we used here. We could drop our deposit in the night deposit and they would clear the checks before the deposit was posted. We had many go arounds with the bank here. We are no longer with that bank. It was not admitted by anyone at the bank, but ended up talking to an ex employee and said that yes they did that sometimes, even though they were not suppose to and if they made a mistake in doing that and it was caught, it was not corrected.
