Overdraft Fees/NSF - Bankruptcy - PDLS

Question. I am currently overdrawn 1,200 in my account due to PDL NSF fees. The madness finally stopped and so now I am going to make an arragement with the bank to pay fees off and close this account. I don't want it to go to checksystems so that is one of the main reasons I am making these payments. Now I am highly considering bankruptcy. I know I can add overdraft fees to chap 7. Once I file, do I still have to pay these NSF fees or will it be forgiven? Again my main concern is I do not want account to go to checksystems.


First of all you might try opening another checking account at a different bank and getting established if for some reason it does go to chexsystems. As far as I know it should be forgiven. chapter 7 wipes you of your debts...but seriously, you need another account at a different bank to save yourself in the long run of not being able to open another account.

I actually opened another checking account about 3 months ago at WF. So so far so good. Just worried they will close it if that BOA account goes to check systems. But my question is if I make payment arrangements with them (boa) will this prevent account from going to checksystems? And when I file do I still have to pay this off since i made these arragements with them or will it be forgiven and also not go to checksystems because it was included in the bankruptcy??? My main thing is I am trying to buy time and make payments to it while my bankruptcy is being processed...

Unfortunately, it still may go to checxsystems, and if it does the bankruptcy will not help it... chexsystems will report you for 5 years on an unpaid account after that 5 years it will fall off. Bankruptcies most normally do not forgive that debt.... As far as the other account goes, you should be fine. Even if your account goes to chexsystems, they should not close your acount...

It could have already been reported to checksystems. I had that happen.If it is for a high enough amount they will do it early. Definitely open another account before it's too late.

Because you are considering bankruptcy, I highly suggest not paying off that debt. It may or may not be wiped out with your bankruptcy but even if it were, it wouldn't help you with checksystems. And that is the only recourse they have. It sounds like your credit is wacked (or would be with bankruptcy anyway). Save yourself the money and tell them to go F themselves. I did it with Washington Mutual. They kept calling about the debt and I finally just told them I would rather die then pay their overdraft fees. Send a letter telling them to proceed with legal action or stop contacting you. For 1,200 (that is unlikely to be collectable) they probably wont bring it to court.
