I am crying as I write this. A loved one of mine has written a bad check in the amount of $251. It was at a grocery store. In the state we live in anything over $200 is a 4th degree felony. I mentioned him in the past, he has been in jail before and is really starting to get his life together. He has bounced checks at this store before but I do not know if it was for this much. He did make good on those, though.
Call me naive but I really believe it was a mistake. The store in the past redebit it twice out of the account but not this time. They have contacted him by phone but not yet in writing (as they did in the past). He told them he will pay when he can and they said no problem, bring it in the store.
Now he's young and I am scared he doesn't know how serious this all is. I will able to help him out but not until Feb 6, should I get him to call them and promise them Feb 6? The check was returned on Jan 7. I just wish he has asked me for advice sooner - he knows what an awful time I had bouncing a check :(
My heart is broken and I am really scared for him. They seem to be okay with it but i do not trust collectors. any advice??

perhaps, either way i am still concerned :( do you think he will be able to make good with this check? I am seriously worried for him regardless of good or bad. i mean family is family..
in the past, they sent him the notices and he paid, so i do not think he is worried about this at all.. which scares me because i know how serious this is. he is only 23 years old and maybe i do not know the whole story but am worried for him.
Also, he has written hundreds of checks to this store in the past. I am sorry for being defensive, I just am really worried and do not know how to guide him. I am basically the only family he has and to be honest wouldn't even care if he wrote a bad check for food. everyone who knows me on this board knows that i try to do the moral thing and pay everything i owe. now i am just trying to help someone else.. :/

I wonder why do they keep taking checks from him? Most places won't take checks anymore after the first time you bounce one...

Bottom line is the store just wants to get paid. It's more headaches and waste of time for them to file police reports and show up to court. They'd rather he just pay it then go through that.

The question is how long will they wait? Obviously the sooner he pays it back the better. He should at least be in contact with them and see if they can wait until Feb 6. In the absence of communication, they may be inclined to take further action.

He also has the fact that they didn't re-deposit the check yet. I don't know about other states, but in IL it's not considered criminal until the bad check is redeposited and bounces a second time.

It's hard to force sense into someone, especially at that age. When I was 23 I thought I was invincible and I did many things that could have put me in jail. Looking back now, I know better. But I basically did have to hit a rock bottom before I realized I could do better with my life. That being said, maybe he does need some tough love.

He's lucky this place seems to know him, and they know eventually he'll make a bad check good. But that also makes him meloncholy to the seriousness of it. One day he might write a bad check to someone who doesn't tolerate that and they might prosecute just to make a point.
