These people keep calling me every week and on Saturday mornings starting at 8:15 am What a way to wake up on Saturday morning (I am unplugging my phone on Friday nights so I don't hear it ring then plug back in late Saturday morning) Then they call again around 1:00. THis is for a credit card I have with them. Yes I owe money on it and no right now I cannot pay the balance or make a payment until next week. I got a call from them today at work. I told the lady that I spoke to that I may be able to make a payment next week not this week. Can I send these people a do not call letter? and will they abide by it. I know once I start making payments they will stop calling but right now I won't be able to make a payment until next Friday. The lady said they will keep calling until I make a payment or two. They will not work with T&C and if they did they would get their money from T&C more than they would from me. Don't ever get a credit card from these people!

Even if you are unable to make the payment at this time, the company should not call you repeatedly after you have told them the facts. Moreover, it's wrong to say that they will keep calling you until you pay them. I suggest you to file your complaints against these people at the local AG's office. Once you have shown your move, they will come in the best of their behavior.

I can understand your problems in the financial front. If possible, try to clear up the amount by making payments from next week. You will get rid of them fast.

We had an acct with Credit One, and they already charged it off. After only one month!
Yes, they won't work with T&C, but if they turn it over to collections the collection agency would more than likely work with T&C.

Sadly fdcpa doesn't apply to original creditor, so unless the calls are coming from NCO on behalf of Credit One, they don't have to abide by a cease communications letter. Since you've likely explained your circumstances to several people, they should at least give you the courtesy of not calling so often.

I *think* that if they are informed that your employer doesn't allow personal calls, they have to staop calling you at work though. I don't know if they have to talk to your supervisor, or having a letter on company letterhead sent to them would work. It's worth a try.

Thanks set4sail. This is Bank One not Credit One. I will make one payment - which is very low $21.00 but right now I don't have that (I get paid next Friday so will send Bank One $21.00) thanks to the idiot that used my checkcard in Dallas Texas. I don't have any money until the bank fixes that mistake!!

I thought First Bank of Marin is now Credit One?

I understand about not having $21 right now. Days til payday, and trying to deal with getting out from under the financial stress of the pdl...

So they are still working on the dispute over the Greyhound ticket? You should have been able to fill out a dispute form and possibly get a provisional credit within a few days.

When the credit card company called they said Bank One - maybe they changed their name again.
I'm going in the bank tomorrow to see if I can get an affadevat(?)When I taked to the solutions department on the phone they said they would mail me one. I was hoping it would be solved but it has only been one day.
