Time Frame to file again

You can't file bankruptcy in the next six years. This begins from the date when your debts were discharged in bankruptcy.

Try to look into other options. You will be able to take care of your debts under one of the debt management programs. There are many plans as per individual situations. The counselor will tailor it according to your requirements.

Regarding bankruptcy refiling---mine was filed and discharged in 2001. I was told because of new bankruptcy laws I cannot refile until 2008. So is that seven years? If so, that is different from what you are saying.

If you filed a Ch 7, you have to only wait 4 years from the time it was discharged and then a Ch 13 can be filed. I think it is a 6 to 8 year waiting period between two Ch 7's.

A Ch 7 wipes out all of your debt and a Ch 13 is a debt repayment plan.

Okay----so, if you file a Chapter 7, then 4 years later you can file a Chapter 13? But, if you filed a Chapter 7 and want to file another Chapter 7 then you wait the 6-8 years?

Yes, I'm sure that's the way it works, Lorri - if you wanted to file the same chapter again, you'd have to wait the 7 years. But I have read stories of people who have filed a Chapter 13 on some of their debt and then a Chapter 7 on the rest. I don't know if that's under the old laws or the new ones - it doesn't seem it would be allowed under the new ones. Good question for an attorney.

Why are you needing to file again? Is there any other options that you have such as debt consolidation or contacting your creditors to see if you can make payment arrangements? I know that it is none of my business, but I would like to know how much your debts are? You might just need consolidation and not bankruptcy.

You only file bankruptcy when it is absolutely necessary.

I filed a Chapter 13 in 2001 because I did not meet the 7 year time requirement for a 7. However, I was able to convert it to a Chapter 7 in 2003 and I still had not qualified for the 7 year period at that time.

I filed a Chapter 13 back in 2001 which was converted to a Chapter 7 and was dischargedFeb 2004. If I refiled a Chapter 13 in 2008 that was dismissed when and would I qualify to refile a Chapter 7 or Chapter 13 again?

I filed a Ch 7 in late 2000 it was discharged in Feb. of 2001. Can i file a Ch 7 again now? I just want to know if i can if i had to do it all over again...lol
