I'm 80 k in cc debt . i want to file bk . The cc debt is on 30 credit cards one of my questions is will it cost me more for a lawyer because of this ? The other question is i have two cars that are paid for 1995 worth 1800.00 and 1999 van worth 3500.00 my problem is we have 4 kids under 17 we need the van because we all can't fit into car. will they want to take the van if we file chpt. 7.
I took the means test looks like we qualifiy for 7 . Does the amounts on means test that they detuct for food, utilites , car maint. is that all a standard detuction? I used the numbers that they put in when they asked for # of kids .
I haven't been able to pay on cc in two months i need to do something fast. HELP!


A lawyer should not charge you more because of the number of accounts. Mine doesn't. As far as the cars go, it deends on what state you are in, what your exemptions are. In Florida is it $1000 in equity in a vehicle, per person. My lawyer told me that we could use the value of our wildcard exemptions that we are allowed if the value of the vehicle was over the allowed amount.

I would advise that you get a consultation with a local attorney, and ask him. He will be able to give you answers specifically for your situation.

i also have a rental house 3 months behind about to go in forclosure. i dont want the house have about 10000 in equitity but the house will never sell for that. is it better to let forclose or wait til i file bankruptcy.

If it was me, and I was set on bankruptcy, had already retained a lawyer, and there was not turning back, then I would let the house go. To me, there is not point in throwing money at the mortgage when you are going to lose it anyway. However, I would be concernced about the tenants. I would have a hard time with letting the house forclose, and leaving them in a bind.[/left]
