Does judge automatically dismiss case if I don't appear in the Chapter 7 bankruptcy meeting?

If I miss or don't go to the Chapter 7 bankruptcy meeting of creditors, does the judge automatically dismiss the case?


If you can't attend your meeting of creditors, inform the trustee asap. If you have a valid reason for rescheduling your hearing, your trustee will surely notify you of your new hearing date and further procedures you need to follow.

You need to refile your bankruptcy if you don't attend 341 meeting. This meeting usually takes place 20-40 days after you have filed bankruptcy. Notify your bankruptcy trustee if you can't attend the meeting. Bankruptcy trustees have a very busy schedule. They may not agree to reschedule it unless you have a valid reason.

Will they reschedule it if I haven't informed them previously and failed to appear for the creditors meeting, but want to appear for the meeting if they give another date? Whom should I contact for the reschedule? Do I have to pay something for it? Do I have to apply in writing?

You need to contact the bankruptcy trustee. There is a great probability that your case has already been dismissed.

Once you miss your hearing, the trustee will dismiss your bankruptcy case. However, in some cases, if the debtor doesn't attent the meeting of creditors due to some crucial reasons, then he/she may be allowed to reschedule the hearing.

Below are the most common reasons:


  1. active military service, or

  2. another compelling reason.

  3. Notify the Trustee Immediately

  4. medical or family emergency

  5. serious medical condition

  6. incarceration



But, make sure you notify the trustee immediately.
