ok after meeting with several lawyers it seems my only conclusion is to do bankruptcy... i have a little over 17k in cc debt without interest as of now... i havent made a payment on them in over 4yrs, and one case is set for court in a week from now, then the collection agency says they have another case pending against me for another one of my old accounts,, thus totaling a little of 10k and the rest i have never heard form anyone as of yet.. my question is, if i lose my case in a week and a judgement is filed against me, and i tend to file bankruptcy, then can the judgement be included in that... because today when i asked the lawyer about my case he said dont tell the judge i plan on filing because he would push the judgement through, and to just ask for a trial date to delay the judgment for a little while so i can get the full amount to pay for the filing on his part... or would the judgment still be there?, if so would i have to pay it?

Judgments can be included in bankruptcy.

Find out a little more information. Check the last payment date on your debts and confirm the SOL of the state where the account was opened. Judgment on a particular debt cannot be filed after the SOL has expired. If it is within the statutes, the credit company will try to file a case.

Your attorney is trying to delay the judgment. If you can afford to pay the debt, the creditor may withdraw the case from the court. Even if it reaches in the court, your attorney is planning a strong defense for the judge not to order a judgment against you.

Try to avoid bankruptcy as much as possible. In case, you really have to do it, chapter 13 will be a better move when compared with chapter 7.
