I’m in Chapter 13 bankruptcy now. Have borrowed a payday loan in December. Now, I can't pay it off . I was using it to make monthly payment in Chapter 13 bankruptcy. I can't make Chapter 13 payments too. What to do.
Jesus!!! What have you done?
Did you borrow payday loan after consulting with your bankruptcy
attorney? What on earth were you thinking? How could you even think of
making monthly payments using Chapter 13 bankruptcy payment plan?
Anyway, if you have not yet informed your attorney, then I would suggest
that you inform him now. I think he will suggest the court to modify
your current payment plan. If that isn't possible, then you may have to
dismiss this case.
Hey Saliabery!
You are saying that you are in Chapter 13 bankruptcy now! But let me
tell you, to qualify for Chapter 13, you will have to show the
bankruptcy court that you are having enough income after deducting
certain allowed expenses and necessary payments on secured debts (such
as a car loan or mortgage) to make bankruptcy payments! So, I believe
that you have shown it!
Suddenly, if you are going through a financial crunch, I would suggest
you consult financial advisors who are experts in bankruptcy. For your
debt help, immediately call 800-DEBT-913 and seek assistance!
What? You are borrowing money
to make your Plan payments? You are borrowing money without getting the
Court to approve the new debt? As others have said, you better get an
attorney to assist you in fixing the problems you have created - if they
can be fixed. My guess is you are headed to a dismissal of the case or
a conversion to a Chapter 7 and, if you filed a Chapter 13 to save
something (like a house), that "something" is going to be taken away
from you.
