Surrendering your vehicle when you file

I am in the process of filing Chapter 7. We are going to reaffirm one car and give up the other when we file. Has anyone gone through this? Did you drop it off at the dealership or was it repo'd?

The attorney tells me they will come and pick it up. I rather not have a flatbed come here and pick it up unexpectedly in the middle of the night! Losing the car is bad enough. Anyone have any experience with this?


I don't have experience with it yet, but if your loan is with the dealership, I don't see any reason why you couldn't take it there instead of waiting for them to come and pick it up. You would want to be sure that you get proper paperwork showing that you turned it in.

Maybe others have more information.

We had a voluntary repo towards the beginning of May and I have to say our finance company were horrible to deal with. We were the same way didn't want a flatbed coming to haul the car away. The car wasn't late on payments at all we just knew we couldn't keep making the payments, in fact we had 2 more weeks before another payment was even due. So we told them we really wanted to keep the car through the weekend and we would gladly drop it off whereever they wanted. The lady at the fiance company said this was fine. Then 2 days later the repo guy called insisting if we didn't let him come that day and get the car we would be charged 495.00 which made no sense because the car wasn't even due a payment for 2 weeks. He then asked what kind of car it was when he was told it was a Mustang GT he quickly asked was it running of course it was and informed us he'd be driving it away v/s hauling it. About an hour later he was seen by several people driving it around our town. VERY VERY unprofessional. I was very upset by the whole process. I think if it's a voluntary repo they should allow you to give the vehicle up at your convinence providing there are no late payments. I hope you have better luck then we did with returning your car.

That is a crock of bull$$t, how dare him drive it around town like that and besides the fact that the car payments were made up to date at that moment. I would raise helllll with the finance company and turn them into your local state dept of finance in regards to this unethical way of doing business.

It sounds to me like the guy was trying to make a quick $500.00 from you.

I fully agree with you. I think he figured we really needed to keep the car and would just agree to pay the money and he would have pocketed it. I see no reason he should make that money when our payments were current. Which we tried to explain to him but he wanted nothing to hear of it. He kept insisting once he received the paper work he must follow up. Which I don't agree with because we had called the lady at the finance company who said it sometimes take the repo guy a week or longer to get in touch since it's being done voluntary and that they make arrangements at your convience but he sure wasn't doing none of that. I was quite mad but at the time just let them take the car because I sure wasn't paying him almsot 500.00 to just wait a few days. Because I believe he came on Friday to get the car and we weren't wanting to give it up to Monday which the lady ha agreed was fine and I still can't help but wonder what day they actually turned the car in. Because when they picked it up we had actually filled it up with gas because we were anticipating keeping it all weekend. So who knows when they actually got the car back. I do know we just got the deficiency balance and it's insane. They sold the car at auction for so much less then it was worth so we're left owing them 9,720.62 which I think is so crazy for a car of course we don't have. We already paid them over 5,000 8 months we had the car.
