is filing worth it?

Hello,

Here is my situation, I have been married for almost 6 years and I have personally accumulated almost 40,000 in credit card debit. I am paying about 750.00/month in payments. I had most of this debit before I was married. I am starting to feel the crunch paying half the mortgage and bills, plus my student loans and credit cards to the point that I am not making enough to cover the costs each month. I don't want to ruin my wifes credit (she is not listed on any of my debt except for our home) by filing. I want to know if I can file to get out from under my credit card debit without hurting my wifes credit. Will it also effect our mortgage if I file, because it is the credit cards that are killing me. I have been making my payments ontime, but I will have about 2-3 months before I start going backwards. My wife and I both work fulltime and I can pay my credit card per month, but not 750.00...Thanks!


If you do a search for T&C (Town and country) You will find that they may be able to help you depending on what state you live in. I do know that if you are in WI they are not taking WI residents right now. But many members here have used them and they are doing great. You will still be paying those bills but they can lower the payments for you. But I don't think they will work with the student loan. You can ask. But do a search and read up on them. Also if you register you can sign up for a free consult. from a credit counsler from your area. It's all free, plus then when you sign in and post here you will earn points which you can cash in for money.

I believe that if you file she will also have to seeing as you are married. But yet I live in one of those states that affects married couples that way. So when we filed we had to do it together.

You could contact a lawyer over the phone and ask about that. Usually the phone consult. is free. But you can always keep checking back to this post and someone will be along to give you the right info. But I do know that with the new laws you will have to go see a counsler for their recomendations before you can file. But the lawyer will send you there. Thats what a friend of our had to do when he filed earlier this year.
