too much expenses

I don't know if we are even going to be able to file this chapter 13. There is not very much money left at the end of the month. I just added up the expenses and it is depressing. I didn't even factor in if one of us has to go to the dentist, I cut the grocery allotment, cut out all entertainment and upkeep for the house.......I finally got it to show about $400 extra a month in that way. Is that going to be enough left over for the chapter 13? We aren't keeping any vehicles or anything, just the house.Are they going to use EVERYTHING left over at the end of the month or at least leave us a little extra for emergencies?


I don't know how they decide the budget since the laws changed. I know in my case I had to have at least $1,020 left in my budget in order to qualify. I can tell you from my experirence, I have had to work second part time jobs while working full time and going to nursing school part time. I did this on occassion when I knew I needed the money (ie: xmas for my children, school books, etc...) In cases of emergencies like car repairs, buying a new household appliance, you are allowed to contact your attorney who can get that expense approved through the courts, you will receive a "refund" check for that amount or close to it, depending upon how much your trustee has in your account. But this will prolong your bk, but if you need it, you need it. I had to do it twice. Don't be alarmed by the amount of money I had to have left in my monthly budget, I am a single parent with two children who are severely disabled and I had to have enough in the budget to cover other medical expenses such as monthly medication refill co-pays, childcare expenses, and I don't receive any child support. $400 is a low number, you will need to show you can cover groceries, utilities, gas for the cars, and insurance for cars. Somebody will need to get a second job, I don't know how you could survive on $400/mo, I am just being honest.

Oh, the $400 is AFTER all the expenses, groceries, gas for cars, all that. That is with medical expenses and insurance and everything. As far as a car goes, I have one vehicle that is paid off that I am going to drive and we are getting another used vehicle that we are buying cheaply this weekend. I already talked that over with the attorney. Does that make any more sense? Sorry my first post wasn't very clear. Thanks for the good info, it is good to know that if you have a true emergency you have something to fall back on. That is what I was really worrying about.
