bankruptcy - family size

I am sixty years old and single and just found out I will be sued by a credit card for a 3-4 year default.
Already tried paying through a credit councelling service. Now Considering Bankruptcy.

Two questions - my 65 year old sister moved in this spring after her husband died. She only gets a small Soc Sec check and helps me with the utilities. I have a 21 year old daughter away at college.

How will the bankrupcy system determine my family size. 1,2 or 3?
Will my sisters social security be considered? She is sick with cancer and uses her money for heathcare.


Hello and Welcome! I don't think your sister's income would count. Not sure about the daughter in college. You have to met a "means" test if your income is low enough you could quliafy for Chapter 7 if not then you could still do a Chapter 13. I'm not completely sure, but I THINK that your family size will be one since you are unmarried and have no dependent children. I also THINK that you will have to count the portion of your sister's income that she contributes to the household expenses, but not the rest of it.

Most bankruptcy attorneys will give a free initial consultation. It would probably be worthwhile for you to go in and talk to one.

My boyfriend was about to marry me and now he is in prebancruptcy situation...He said it's better to wait with marriage because it's going to affect me. Is it true?
We don't have any business together, I live as a houswife in his house for almost 2 years, I have no income, all my belongins are my car and my clear good credit...(I'm an immigrant with Green Card) Thank you.
