What can I do?

I am considering filing for Bankruptcy, but i dont want to loose everything i have. I own 3 cars and 2 house. The cars are free and clear but the houses were both tied up in a debt consolidation loan with Wells Fargo for about 50,000. I also have about 30,000 in credit card debit. I believe i can turn the cars into my son's name to not use them in the bankruptcy, but what should i do about the houses? I live in one now and my daughter lives in the other. please help


With the new bk laws that is not a good idea to put the cars in your son's name. They will look to see any assets in your name for a period of time (i think 3 years) before filing, and you will have to explain why they were put into your son's name. If you are doing it just to avoid losing them, that is considered bk fraud and is a federal offense.

Why not try to sell one of the houses? Or some of the cars? It sounds to me like maybe reducing your lifestyle is a better option then filing for bk, but I don't know the whole story either . . . .

One of the cars is mine, other is the wifes, and the other one i bought for my daughter which she uses. The houses dont have alot of value at all. Selling them both wouldnt even pay off the loan from Wells Fargo. The house I live in is the original when my wife and i got married, last time we had it appraised it was worth maybe about 25,000. The other one was appraised at 15,000. With the community and area I live in it wouldnt sell as fast as you think.

You would probably have to do a chapter 13, if you want to keep the house. In a chapter 13 you will end up paying back 50 - 90% of your debt. It isn't such a great deal anymore. But it may be worth looking into. I would contact a lawyer in your area. Most will do a consulation for free. Just remember, a lawyer is going to try to talk you into the bk, because they don't get paid if you don't do it. Please look into all other options too, and weigh what would be the best choice for your family.

But the hiding of assets is really not recommended.
