I am going to file Ch. 7 for my husband and I was wondering if anyone could tell me what website to get the correct forms for filing his ch. 7. I wanted for him to get an attorney to do it but each attorney wants between $1,400-$2,200. The only debt my husband has is 9 credit cards and 3 medical bills so I would think his ch. 7 would be easy because we own no cars or homes and he only makes $1,200.00 per month. ANy help is appreciated.


Process involved in bankruptcy 7 filing are: -
1. You are required to get a credit counseling within 6 months prior to bankruptcy 7 filing. This counseling should be done by an counseling agency approved by US Trustee. You can get a list of such agencies from "Credit Counseling and Debtor Education" section of the site usdoj.gov/ust .
2. Then you have to fill up a petition along with some other forms with your area????????s bankruptcy court. These forms generally ask you to give information on the following: -


3. then you have to hand over all your property under bankruptcy estate to the trustee. When you have completed these processes then an automatic stay order goes on harassment and you????????re thus protected from collection malpractices.
4. 1 to 2 weeks after filing, a trustee appointed by the court will take over your finance and review your paperworks. He is the person who will manage any action taken on the property.
5. Court will fix a date of meeting between you, the trustee and your creditors anywhere from 20 to 90 days after filing.
6. Based on all the information of your finances, court confirms or rejects your bankruptcy chapter 7 petition. If the petition is rejected then you will be given a time period during which you can file for bankruptcy 13.
7. Non exempt property will be sold to repay your creditor debts. You may be required to give up any property that has an unpaid secured loan.
8. You have to go through mandatory financial management classes.
