I was just curious how long it took those of you who has filed BK, how long it took you to file once you retained your attorney? We are paying our retainer this Friday, but it will be serveral weeks before we have enough to finsih paying him and our filing fee. Reny

We retained ours on a Thursday (I think), paid our retainer that day (only because my husband was paid every two weeks at that time and it was a month with an extra paycheck in it), and filed the following Tuesday. We wanted to file in that month because we knew that we met the means test at that time (turns out my husband lost his job, so it wouldn't have been an issue anyway). Because we had a couple of issues that could have been potential problems if we had a picky trustee, our attorney recommended that we file right away because by doing that we would get assigned to an easy trustee--and we did!

I had my first consultation with my attorney on a Thursday. I gathered all of my financial papers and dropped them off at his office with a personal check for $1500 on Friday. I did my credit counseling on Friday afternoon and he filed my petition on Monday.

The petitions they use are very straight forward, listing all of your debts and the creditors. Now I'm just waiting for my 341 hearing date.....
