I'm thinking of filing bk, I owed 30k+ on unsecured debt. One of this is CASH CAll ($11K). I know that CASHCALL is very hard for debt settlement company. Is it possible to include CASH CALL in my BK? Also, Who give me a means test? I hope I would qualify for Chp 7, because I can't afford to pay my unsecured debt since my mortgage payment went up

The means test is applied by the court. If you hire a lawyer they will do the paperwork. If you income is under the median income for your area, you can file a chapter 7. If you income is over, you can continue on with the means test, and still possibly file a 7, although it gets much tougher. If your income is way over the median, you will have to file a chapter 13. The crappy thing is that with the new laws, actual expenses do not come into play. You can only use the median expenses for your area. So even if you mortgage payment is $3000 a month, if the average in your area is $800, that is all you can claim as an expense.

Thanks, I already hired a lawyer and he asked for $ 2,200.00. asked both our income and expenses, and amount of debt. After reviewing everything, he told me to file for Chapter 7. I have some doubt because of our income. Also one of the debt settlement rep told me that we are not qualified for Chpter 7 because we have job. I just want to make it clear, so before we go to court, we knew already which one we're filing, right? And the court will approve or deny it, right? thanks again.
