Looking for Ch. 13 information

To make a long story short. My wife and I have been dealing with major medical issues with our son, my wife and her father (she is the only family he has). We fell WAAAAAAY behind and are about to lose our house as we had to put the health of our family ahead of our credit.

Anyway, I am trying to find some help/advice/information on Ch. 13 in Florida.
I looked into "credit counseling" and they won't touch me becuase I am behind on the house and only deal with "unsecured" debt. GEE THANKS

1. Lawyer costs I will need up front. I have heard between 1K-2K up front. If i can't pay my bills how am I going to get 2K for a lawyer.

2. I was also told as part of the repayment play the courts garnish your wages. I work as a bartender. I work for tips. No way to garnish wages unless they think the $3.56 an hour bartenders make before taxes will be enough. :-) But how would they get my money out for the repayment plan.

3. I want a good lawyer and want to know if anybody on here knows of one in the Central Florida area.

4. Any other information I can get.


I am finishing up my chpt. 13 within a few months. Don't do it, unless you absolutely have no other recourse. Have you tried contacting your lending and working out a solution? Also is this a FHA mortgage? FHA has programs to prevent foreclosures, try checking into that first, if you have an FHA mortgage that is. Since the new bk laws passed in 2005, life for a person in bk now is very very very difficult to survive just trying to purchase the basics needed on a monthly basis.

Steelers. I am at that point now withought bk.
We have contacted the lending company and they are willing to work out a repayment plan, but they want almost $500 more than our current payment, then in 6 months they will consider rolling the remainder into a new mortgage. I don't have an extra $500 on top of what I can't pay now! My wife has to stay home and take care of our son.

We were looking at selling our house but the market has gone down here and we are upside down at this point so not an option.

This is going to sound stupid, but how do i know if i have an FHA mortgage? We have the typical "Horror story" refinance. Got to closing and terms changed but had no other choice becuase we had used that months payment to catch up on other bills. etc etc.

I just can't lose my house!! I make decent money. $45K-50K a year, but due to pdl hell, I can barely put food on the table <------ not joking.

I know you have helped me with PDL's and have sent in my 1st letter today demanding pif status and refund. Work on the rest after I get the "feel" for this one.

Can't remember, are those internet payday loans?

Contact your lender and ask if it is a FHA loan. If you have to file to save your house, you have to file. But be warned, you will continue to struggle, if not struggle even more, just to provide the basics to your family monthly. I know this sounds rough, but can you temporarily take a second job until you pay off the extra $500/month? I only say this because I am watching a few of my neighbors go through hell now that they've filed chpt. 13, they can barely meet monthly expenses, and saying they are worse off now than before they filed chpt. 13 due to the new laws.

And I have to say this, screw the payday loans if it means making that extra payment each month to the mortgage company. If they are storefronts, stand firm on an agreement to payback the amount borrowed and don't let them bully you. And if they are internet pdls, don't let their illegal threats get to you. Close your account and open a new one.

To prevent them from contacting you at work, do not avoid their calls at home. Answer them. And tomorrow, I would be filing complaints with the AG. Did you put in your settlement letters that you are forbidden to receive personal calls at your place of employment, but would accept calls to your home? That has worked for others.
