Question re: Ch. 13 and payday loans
Date: Sat, 06/09/2007 - 13:30
We're filing for Ch. 13 bankruptcy on the 19th (long story short, I've struggled for 2 years to get out of the PDL trap that I got myself into, fallen behind on everything, and reached the conclusion this is what's best for us & our future). My question to those of you who have gone through bankruptcy with PDL's, how & when did you tell them you were filing? Before you filed or after? My next due date is the 15th, 4 days before we would actually file. Should I be upfront with all of them and say we're filing, and that they'll get paid back in the plan (like I haven't paid the principal multiple times by now, but anyway!) or do I put them off until we file? 4 of the loans are internet, the rest are storefronts (who I have really good relationships with, which is why I'd like to be honest & upfront with them, but not if it's going to bite me in the end). I've closed my account that the internet ones would deduct from--should I contact them anyway? I don't want them calling my work...
Any advice is appreciated! :?

Yes, you should let them know. Not that if you don't anything bad will happen. I wouldn't notify the internet ones, they will try and scare you telling you that you can't include them which is total BS. They will find out soon enough when they are notified and given the chance to file a claim with your chapter 13 case. Storefronts shouldn't give you any problem, they may still try to contact you until they receive notification from the court you have filed. You will be fine either way.
