Can you refinance your home mortgage while in Chapter 13?


Yes, you can. There is also the possibility of refinancing your home OUT of the Chapter 13, if you are able to obtain a refinance with enough extra money in the loan to pay off your Chapter 13 Bankruptcy.

HOWEVER....

At this time, you may find this to be a very difficult thing to do, what with the lenders severely tightening their lending criteria due to the subprime mortgage crisis. If you are in Chapter 13 Bankruptcy, you may be hard pressed to find a lender who will do this for you at this time.

Speak with your bankruptcy attorney and ask them to refer you to a lender - they will know of lenders who will be able to help you, if any are available.

Is it still possible if one sponse filed Chapter 13 bankruptcy and the other did not. The mortgage is in both names. But one sponse wants to have the mortgage only their name. The one that did not file Chapter 13 bankruptcy. Please advise!
