Can they repossess your vehicle while in bankruptcy?

We filed for bankruptcy today and I received a phone call 5 minutes ago from our auto loan company they said our payment was returned nsf. I called my bank and found out that a payday loan company took the money. I called the auto loan company back and explained what had happened and that we had filed bankruptcy and the car would be included but we were going to rework the payment and keep the car. They said I have until 7 pm today to make the payment or they will pick up the car tomorrow.
Can they do that?


Your attorney has to forward the case number to the auto loan company. They are not supposed to pick your car after receiving your info from the attorney.

What type of bankruptcy did you file for? If it is chapter 13, I believe the payment plan is already fixed by the trustee and the auto loan company will take the payments fixed in the plan. There should be no threats of picking up the car.
