Odd question

I'm collecting my paperwork together for my bankruptcy and I'm missing my 2008 tax returns because they were destroyed in a flood that hit my home. I told my attorney this and he told me that we can work around this using my 2009. Have any of you heard this? I thought the last 2 years tax returns were needed.

my attorney is requesting my last 4 years of tax returns. how did you get your 2008 done, luckily i was missing my 2006 tax returns but i had them done at jackson hewitt so i was able to get a copy from them. but if nothing else like SoapLady said, you can get a copy from the irs. i just think it takes alot longer.
