My husband and I considered bankruptcy a couple of years ago and saw a lawyer paid the fees, but told them we felt the need to wait. They said we would have to file a 13 and with retirement pending we didn't see how this was possible. So now the time comes that my husband is on SS and while he is pretty much exempt from being dogged I am not. The question is we live in a community property state can I file without him seeing he is on SS or will his creditors dog me? Thanks for any advice you can give me!

His creditors can go after you in a community property state unless the debt was acquired before you got married. Unless it is from before the marriage his debt is your debt. The good news about that is that if you do file for bankruptcy you will file jointly and be able to get rid of both your debt.
