bankruptcy after marriage

I am getting married in April 2011. I am planning to file bankruptcy in May. My future husband has good credit. Now, my question is, if I file bankruptcy after my marriage, will it affect my husband's credit in any way? I don't want his credit to suffer.

I don't think it will be a good idea to file bankruptcy after marriage. The total bankruptcy process is a complex process. It involves loads of documents, meetings, hearings, etc. Another thing, have you informed your future husband about it? if he knows and is perfectly fine with it, then it is not a problem. But, if he doesn't know about it, then inform him. He may not like the whole thing.

Yes, you can always file bankruptcy after your marriage. If both of you live in a community property state, then your husband will not be accountable for your debts after marriage. So, if you file bankruptcy after marriage, it won't affect his credit. A legal expert can give more details about it.

Bankruptcy is not that complex. One or possible two meetings with your attorney and one court visit.

Have you gone thru the means test? I believe it will take into account your spouses income if you are married..double check that...it could affect which chapter you can file.

This is backwards....if you live in a community property state, he would be responsible.

I know a couple trying to get BK filed and it has not been that easy. Their attorney came recommended and it's been a nightmare.

We had been advised to do it and I am so glad we didn't. We ended up settling debts and am so glad that, for the rest of my life, I don't have to answer the question, "Have you ever filed bankruptcy?"

That should be a VERY LAST RESORT!
