Chapter 13 Candidate, Car Statements to Different Address

Good Afternoon!!

I am currently considering Chapter 13 Bankruptcy. I have moved out of state within the last 7 months and my car statements have been going to a different address than where I currently reside. I have namely done this to prevent them from Reposessing the car, as I am 90 going on 120 days delinquent. I have been making monthly payments every month, just unable to pay the full amount. In researching Chapter 13, I saw something online saying that my statements from my creditors need to reflect my current address for the last 90 days, and was wondering if that's a dealbreaker for working something out with including my car in the filing. I want to keep the vehicle, but don't want to let them know where it is until my bankruptcy is filed.

Also do I have any recourse if I tell them that I am going through the Chapter 13 process, or should I keep my mouth shut and stave them off until my papers have been filed?

I will suggest you to contact a bankruptcy attorney and discuss your situation with him. The bankruptcy attorney will guide you regarding the whole process and let you know what you need to do regarding your vehicle. You won't have to inform your car lender about the bankruptcy filing. After you file bankruptcy, your attorney will inform the creditors/lenders about it and due to the automatic stay they won't be able to come after you regarding any debt.
