If I file bankruptcy and have exagerrated my income in order to get a credit card, will they credit card debt be discharged? I've heard some say it is considered fraud and others say don't worry about it because the credit companies would never contest it.


I think the major question is this: does the credit card company or the bankruptcy attorney KNOW that you exaggerated your income to get the card? It surprises me that you got the cards at all, given all the checks that are done on credit, etc. these days.

However, your statement that most credit card companies do not contest bankruptcy is correct. They usually don't. BUT....be careful if you have a Sears store credit card. They are notorious for showing up at the 341 Meeting of the Creditors and demanding the return of any merchandise purchased with their store card. Quite often, they are the ONLY ones that show up. I'm not sure why they even bother, because usually the items purchased are in, at the very least, used condition, and in some cases, are worn beyond the point of having any value to Sears at all. But it seems to be the norm for them to show up and try to get their merchandise back.

I wonder if the Sears store card is still like that. I know they used to be, but they are now issued by Citibank, and I don't think the slip you sign says Sears has a security interest in the items purchased, as they used to.

Does Visa, Mastercard etc. actually every verify income? I had a good credit score which is why I got the credit cards. I guess I will go ahead and file since it seems like I will be okay. I'm curious if Visa actually ever verifies income.

its more of a credit verification now, and see if where you work matches that in your credit report, but nowadays they might have the info on file. More and more companies are sharing info now, but dont worry about what you put on the application....

but going forward, just be up front and honest!
