Getting employed after filing for Ch 7...what a dilema
Date: Fri, 05/01/2009 - 14:56
My wife and I filed for joint Ch 7 the first week of April after both lost our jobs for over a year. She was able to land a full time job (thank god) last week and we are waitng for our 341 meeting on May 15th. How would this impact our case? The following is snapshot:
1. Family of 4 living on unemployment benefits ($1,700/mo) for at least 6 mo prior to filing in April.
2. Income from the new job will make us on the brink of passing/missing the means test although I know the test is based on 6 month average income PRIOR to filing.
3. We are $200k in cc debt and there is no way to go into Ch 13 to pay off them, so Ch 7 is really a make or break for us...
We are even thinking of her leaving her new found job to get a better shot at the 341...what a painful dilema...
Any advice/similar experience sharing is much appreciated...our lawyer is useless

He first said after filing it's ok to get a job...as long as it's not a million dollar a year (we wish) job, then he is not as sure, saying we probably should wait after 341. It's too late to hire a new lawyer but maybe this board can have more insight...many thanks
