We filed chap 13 and 5 months later we realized is was a huge mistake. Payments were too high already with a possibility of getting even higher. We got it dismissed for non payments, now we are overwhelmed with collection calls, what do we do now? Is it even worth to pay it back since it will be in our credit report for 7 years?


Soaplady is correct. If you had qualified for a 7 when you originally filed you could have converted to a 7. You can still file a Motion to Reinstate (for the sole purpose of converting), HOWEVER, we do not know why your filed a 13. Maybe you were trying to save a house or car. Maybe you were trying to pay back taxes. Maybe you had assets that you were trying to keep. Or, maybe you simply did not qualify. If you can, post a few more details and maybe someone can give you "words of wisdom".
