I am close to filing my Chapter 7 my attorney advised me that I will most likely be served that a creditor is in dispute. What section of my local court house do I serch for to see if this has been done? It is Bank of America they say the have evidence of certain things which we can back up that this is all false. My attorney said they proposed a settlement but he says it is just a scare attempt to get money. He said if they feel they have all this eveidence why would they settle for .10 cents on a dollar. What are your feelings on this and has this practice been used on others? I just cant wait to get this over it is so hard on me wearing on my health!!!!I do alot of praying so I can move on with my life.Thank you for your time and listening. :(


Lawsuits are filed usually with the district court in your county.

If you are about to file bankruptcy, why sweat it? This and and any lawsuit will be included. Settlements before filing have to be under $500 total I believe, otherwize it is seend a preferential treatment of a creditor and BofA would have to give it back.

Is Bank of America known for saying things that are not true??? Just to try and scare you into a settlement??? I quess any one can do what ever. For instance they said I charged the amount I am bankruping in the last 6 months my card was active since 2005 and my balance on the card in 1/2008 was the same it is today. They also said I made no payments for 1 year not true the last payment was 9/08 I stopped payment as instruckted by my attorney. I have all statements showing all this. They also said 6 months ago I gave them a w2 to for some huge amount to reinstate my account... It never closed I wish I made near they said I had a w2 for. You wonder how they come up with this. My attorney said they have to prove all these things and produce evidence of this. Just adds to more nights of no sleep. Thanks for your support.
