Motion for Stay and Mortgage Payments with Wells Fargo?
Date: Fri, 07/03/2009 - 06:43
We are currently waiting for discharge with our chapter 7. We were late on our May mortgage payment. Sent it off and the next day received a Motion for Stay from the Wells Fargo attorney. They accepted my May payment. I told them I would be sending my June payment by the end of the month and that would bring my account current. Wells Fargo rep said fine and to check when it was received and the attorney would most likely drop the motion. So I called today since the payment had not been cashed and they said they could no longer accept my payments and they had sent it on to their attorney. The attorney wouldn't speak to me, only my attorney. If my attorney gets involved, I will have to pay more money to them so I was trying to handle on my own. My question is...will the attorney for Wells Fargo just apply my payment to the account on their own and then drop the motion? Should I go ahead and send in my July payment anyway? Does anyone have any advice? Thanks!
