Thanks for any assistance you can give me. Long story short, my wife (before we were married) filed for and was granted Chapter 7 a little over 4 years ago. We have run into some reall bad luck and I am now unemployed (but have a job offer in FL - we are in CA now) but she must quit her job and go on permanent disability in less than a month.
So.....I know you have to wait 8 years to file Chapter 7 again but we will be able to afford Chapter 13 once her SDI kicks in an a month or so and I start my new job in 6 weeks or so.
My question is...I have heard from no less than FOUR attorneys that the waiting period for her (us) to file Ch. 13 is 4 years AND 8 years. Does anyone know what the time period is?

Its 4 years from the the chapter 7 filing. However, you can file
Its 4 years from the the chapter 7 filing. However, you can file chapter 13 really at anytime, but the kicker is you will have to payback 100% and be in the plan for 5 years.
you do not have to pay back 100 percent in chapter 13 and it is
