Bankruptcy???

Here is my question I received my chapter 7 discharge back in 01/21/10. I have had creditors contact me for some debts i ethier for got or were unable to locate any information on claming that because they were not named on the bankruptcy petition that I still owe the debt. is this true? My understanding was that any debt owed prior to bankruptcy if not included do to no knowledge of the debt or human error would be included in the discharge. I live in ohio.


I have filed b4 also. I was told to make sure I claimed all and then some. That way no one later can come back to you because they are listed in the petition. I claimed all the present creditors at that time, I claimed a past automobile accident of which I was 25% responsible, anything that could potentially be a problem in the future whether it was now or not. I desperately wanted to keep my $10,000 baby grand and continue making payments on it but was advised to list it and be clear of the debt.

What he was saying here was that someone could legally come back to you and cause you a problem. Whether or not they could win a judgment against you is unknown. But why hassle it.

Now this was about 10 years ago, and the laws have changed somewhat, but definitely check with your lawyer, He is obligated to consult with you on this case since you have paid him for his help. Even a year later.
