I am sorry to hear that. Too bad for the kids.

As far as the lawyer doing both, that is one thing you would have to ask them. I really don't know. It's been over 10 years since I have filed. But maybe you will ba able to make him pay some of the debts that occured during the marriage. It all depends on the state laws. But that would help you out. Why wipe them all out if he can be responsible for 1/2 of the debt.

I am sure someone will be along tomorrow that may be able to answer this better for you. I say for the kids sake nail his butt for as much as you can  I wish you well on this :)

Hi brena,

Welcome to the Community! Feel free to sign up and stick around!

Unfortunately, neither Missouri nor Ohio are Community property states. First, you should file for divorce immediately. During the divorce proceedings, the debt will be divided up by the courts in great detail. And after that, clean it all up with a BK.

You really need a fresh start. i am so sorry to hear that things are going so badly, but there is light at the end of the tunnel and you can put all this behind you.

My best to you.
