Hi! My father went through a heart surgery last month. He didn't have much financial resource to afford the cost of the operation. So, he was refusing to have the operation done. I told my father that I will bear all the expenses. I convinced him that I have the required money. It was a lie. I just didn't want to lose my father. The total medical bill was around $75,000. The fact is, I can't afford to pay that amount of money. I am considering to file bankruptcy. But my friend told me that it can't be discharged through bankruptcy. Is there any truth in it?

1. Whose medical bills are they? Your father is the one who was treated. Did you personally guarantee payment?

2. Medical bills are dischargeable in bk but which one of you needs to file? If it is your dad and he has nothing (no non exempt assets of value and no income other then Social Security) then he is probably judgment proof and most likely does not need to file. If it is you then you need to consult with an attorney to determine which Chapter you qualify for.
