Bankruptcy? YES or NO? Help!

So... I'll try to do the readers digest version of what's going on.

In 2000 or so, I had stellar credit but was hospitalized for about a year and put on disability (SSDI). As a result, I've not had money to pay my bills.

Fast forward to now, I just received a letter in the mail threatening to sue me (from ESM Enterprises?) for an old debt. I do not remember most of my debts (not saying the debts aren't valid) so I am unsure if it is legit that way. I do not know if this letter is legit either, it gives me 30 days to respond.

I have been conned before and do not want to be again. I spoke with an attorney about 6 weeks ago and they wanted $1300 upfront to file - I make $1005 a month (have to pay rent, bills, get food with that!). I will be getting excess in student loan money - shoud I just file with that money? But I would like to reserve that money for school expenses as that is what it is for.

Ack, what should I do?


It's difficult to comment on a big issue like bk with almost no information. Anyway, IMO you first need to respond to the letter you have received from ESM. If they are a collection agency, you then need to send a debt validation letter to them requesting the details about the account. Take help from the sample letters available here to draft your letter.

Next, if most of these debts were accumulated during 2000, then some of them must have passed the sol (statute of limitation). So you need to check with the sol of your state as well for confirmation.
