I line in New Jersey. I am planning to file bankruptcy next month. Me and my wife live separately for the last 2 years. We haven't divorced yet. My wife has refused to file bk with me. So, my question is, can I file bk under this present circumstances? Can I claim her homestead exemption in the house.
Hi! Welcome to the forums! You can file bankruptcy as married
Hi!
Welcome to the forums!
You can file bankruptcy as married with a non-filing spouse. But there will be lots of implications of filing bankruptcy without your spouse. Yes, you can claim homestead exemption. However, a bankruptcy can attorney can tell you about that in more details.
You will be able to file bankruptcy on your own. This will help
You will be able to file bankruptcy on your own. This will help you in discharging your debts. In my opinion, if the house is in your wife's name and if she had applied for homestead exemption, then you won't be able to claim it.
